1. Parties and scope
In exchange for access to Repatory’s covered fitness features, this Fitness Risk Acknowledgment and Limited Release applies to my voluntary use of those features in connection with physical activity. Covered features include exercise information, training plans, progressive-overload suggestions, rest guidance, recovery estimates, logging tools, and workout-sharing features. Repatory is currently operated by Andrew Mark Knight while registration of Repatory LLC is pending. The parties released in Section 5 are Andrew Mark Knight as Repatory’s operator and employees or contractors acting for Repatory in providing these app services. This agreement does not purport to release an independent gym, equipment manufacturer, healthcare professional, or other unrelated third party.
2. Adult eligibility and voluntary participation
I confirm that I am at least 18 years old, have the legal capacity to enter into this agreement where I live, and am signing for myself. I choose voluntarily whether and how to exercise. I may decline this agreement and leave Repatory without beginning or continuing a workout. I understand that account access to Repatory’s training features requires acceptance of the current agreement.
3. Risks of physical activity
Exercise, strength training, running, cardio, stretching, and bodyweight activity involve risks. These include muscle strains, tendon or ligament injuries, joint or spinal injuries, falls, dropped weights, equipment-related accidents, dehydration, heat illness, fainting, cardiovascular events, permanent disability, and death. Risk can arise from technique, load, fatigue, environment, health conditions, unfamiliar exercises, or inaccurate, incomplete, or unsuitable app or user-shared information. These examples do not identify every possible risk.
I understand that Repatory cannot observe my technique, examine my condition, inspect my equipment, supervise my activity, provide emergency assistance, or determine that a workout is safe for me. I voluntarily accept the inherent risks of activities I choose to perform, whether or not every particular risk is identified here, subject to the limits and protected rights in Section 6.
4. Health and safety responsibilities
Repatory provides general fitness information and software tools, not medical advice, diagnosis, treatment, individualized professional supervision, or emergency services. Generated plans, suggested repetitions and weights, recovery estimates, rest periods, and rankings are approximations and may be unsuitable for me. A goal in the app is not an instruction to exceed safe limits. Results and injury prevention are not guaranteed.
I will choose activities and equipment suitable for my ability and circumstances, use controlled technique, follow equipment instructions, and adjust or stop a suggestion that is unsuitable. I will obtain appropriate professional advice when a medical condition, injury, pregnancy, concerning symptoms, or another circumstance makes that necessary. I will stop activity and seek appropriate care if concerning symptoms occur; in an emergency I will contact local emergency services. I do not represent that I have no medical conditions merely by signing this agreement.
5. Limited release of ordinary-negligence claims
IMPORTANT: THIS SECTION MAY AFFECT MY RIGHT TO BRING AN INJURY CLAIM. TO THE EXTENT PERMITTED BY APPLICABLE LAW, I KNOWINGLY AND VOLUNTARILY RELEASE THE REPATORY PARTIES IDENTIFIED IN SECTION 1 FROM CLAIMS I MAY HAVE FOR PERSONAL INJURY, DISABILITY, DEATH, OR PROPERTY DAMAGE ARISING FROM MY VOLUNTARY PHYSICAL ACTIVITY IN CONNECTION WITH USE OF REPATORY’S EXERCISE INFORMATION, TRAINING SUGGESTIONS, OR OTHER FITNESS FEATURES, INCLUDING CLAIMS CAUSED BY THOSE PARTIES’ OWN ORDINARY NEGLIGENCE IN PROVIDING THAT INFORMATION OR THOSE APP FEATURES.
This limited release concerns the identified fitness activities and app services only. It does not release unrelated conduct, existing claims arising before my acceptance, payment or privacy claims unrelated to that fitness activity, or liabilities excluded from release under Section 6. I am not signing on behalf of another person or waiving an independent claim belonging to someone else.
6. Protected claims and limits
This agreement does not release gross negligence, reckless or willful misconduct, fraud, intentional harm, or any liability or right that applicable law prohibits waiving. Where applicable law prohibits a release of ordinary-negligence claims involving death or personal injury, Section 5 does not apply to those claims. Mandatory consumer, privacy, and statutory rights remain protected. Nothing here prevents reporting a concern to a regulator or seeking remedies that cannot lawfully be waived.
The enforceability of a release depends on the circumstances and applicable law. If a provision is unenforceable, it is applied only to the extent lawful or severed as necessary; that does not expand another provision or create a release the law does not permit. South Carolina law and the litigation provisions in Repatory’s Terms of Service apply subject to mandatory rights and applicable venue rules. This agreement does not impose arbitration or shorten the statutory time to bring a claim.
7. Electronic acceptance and record
By entering my legal name and selecting the acceptance controls, I confirm that I have read this agreement, understand the risk acknowledgment and limited release of ordinary-negligence claims, have had an opportunity to seek independent advice, and accept voluntarily. I intend this action to serve as my electronic signature. Repatory records my verified account identifier, entered name, agreement and terms versions, document hashes, confirmations, and acceptance time to document the agreement. I can download my acceptance record and review the agreement afterward. Personal information and deletion are handled under Repatory’s Privacy Policy.
This agreement applies from my acceptance forward while I use the covered fitness features; it does not apply retroactively. Material changes to the agreement or a change in the identified operator require a new version and renewed acceptance before that revised agreement is relied upon.
